신자유주의 시대 사적 복수의 시스템화와 정의의 탈정치화 : <모범택시>, <지옥에서 온 판사>, <국민사형투표>를 중심으로

초록

본 논문은 2020년대 한국 드라마에 나타난 사적 복수 서사가 단순한 개인적 응징을 넘어 하나의 견고한 시스템으로 정착하고 있는 현상에 주목하고, 이것이 신자유주의 시대의 정의를 어떻게 탈정치화하는지 고찰하고자 했다. 이를 위해 <모범택시>, <지옥에서 온 판사>, <국민사형투표>를 중심으로 사적 복수의 외주화, 이원화, 플랫폼화 과정을 분석하였다. 특히 데이비드 갈런드의 표출적 정의, 웬디 브라운의 통치 합리성 비판, 사라 아메드의 정동 경제 개념을 유기적으로 결합하여 대중의 처벌 정서가 스펙터클의 소비 회로로 포획되는 인과 사슬을 규명하고자 했다.

첫째, <모범택시>를 통해서는 복수가 철저한 비용 산정에 의해 거래되는 정의의 외주화 양상을 살펴보았다. 이 과정에서 정의는 소비 가능한 상품으로 전락했으며, 시민이 공적 가치를 숙의하는 정치적 주체가 아닌 사적 비즈니스의 소비자로 재배치되고 있음을 밝혔다.

둘째, <지옥에서 온 판사>에서는 사법 체계 내부자가 스스로 법의 효력을 중지시키고 초월적 폭력을 행사하는 정의의 이원화를 추적하였다. 슈미트·아감벤의 예외상태 논리와 아메드의 역겨움의 수행성을 결합하여, 역겨움 발화가 가해자를 경계 대상으로 고착시키는 동시에 목격자들의 공동체를 형성하고 대중을 수동적 목격자의 위치에 고정시키고 있음을 확인하였다.

셋째, <국민사형투표>에서는 사적 제재가 디지털 인터페이스 및 다수결 알고리즘과 결합한 정의의 플랫폼화를 고찰하였다. 대중의 사법 불신 정서를 자극하는 공포의 정동 정치학과 위기 선동을 통해 정치적 숙의의 대상이어야 할 정의가 찬반의 데이터 수치로 치환되는 디지털 포퓰리즘의 징후를 진단하였다.

결론적으로 세 텍스트에 나타난 사적 복수의 시스템화는 대중에게 극단적인 카타르시스를 제공하지만, 궁극적으로는 사법 불신을 야기한 구조적 모순을 은폐하는 기제로 작동하였다. 텍스트 내부의 명시적인 자기반성적 서사와 비판적 거리감마저도 대중문화 시장의 정동 경제 회로 안으로 포섭되어 스펙터클로 무력화됨으로써, 공동체의 가치를 숙의해야 할 정치적 주체인 호모 폴리티쿠스는 각각 소비자(외주화), 수동적 목격자(이원화), 익명의 클릭자(플랫폼화)로 변모하며 증발하고 있음을 규명하였다.

Abstract

This study focuses on the phenomenon in which private revenge narratives in 2020s Korean television dramas evolve beyond simple personal retribution into a robust system, examining how this evolution depoliticizes justice in the neoliberal era. To this end, the paper analyzes the processes of outsourcing, dualization, and platformization of private revenge, focusing on the series Taxi Driver, The Judge from Hell, and The Killing Vote. Specifically, by synthesizing David Garland’s concept of expressive justice, Wendy Brown’s critique of neoliberal rationality, and Sara Ahmed’s framework of affective economies, the analysis elucidates the causal chain through which the public’s punitive sentiments are captured within the consumption circuits of the spectacle.

First, Taxi Driver exemplifies the “outsourcing of justice,” where revenge is transacted through rigorous cost calculations. In this process, justice is reduced to a consumable commodity, and citizens are repositioned not as political subjects deliberating on public values, but merely as consumers of private business services.

Second, The Judge from Hell tracks the “dualization of justice,” wherein an insider of the judicial system voluntarily suspends the law’s efficacy to exercise transcendental violence. Combining Carl Schmitt and Giorgio Agamben’s logic of the state of exception with Ahmed’s performativity of disgust, the analysis demonstrates how utterances of disgust fixate perpetrators as objects of exclusion, while simultaneously forming a community of onlookers and anchoring the public in the position of passive spectators.

Third, The Killing Vote reveals the “platformization of justice”, where private sanctions are integrated with digital interfaces and majority-rule algorithms. Through the affective politics of fear and crisis-mongering that exploit public distrust of the judiciary, the study diagnoses symptoms of digital populism, where justice—which should remain an object of political deliberation—is replaced by binary voting metrics.

In conclusion, while the systematization of private revenge depicted in these three texts provides the public with extreme catharsis, it ultimately functions as an ideological mechanism that conceals the structural contradictions underpinning judicial distrust. Even the explicit self-reflexive critique and critical distance embedded within the texts are subsumed by the affective economic circuits of the mass culture market and neutralized into mere spectacles. Consequently, homo politicus—the political subject that ought to deliberate on communal values—mutates and evaporates into a consumer (outsourcing), a passive spectator (dualization), and an anonymous clicker (platformization).
